Town of Fishkill police serving a Temporary Order of Protection on a Crosby Court residence in the Town, arrested David R. Messina 29 of Fishkill.
The investigation stemmed from a domestic incident earlier in the week. Ultimately a Temporary Order of Protection was requested and issued by Dutchess County Family Court. Messina was ordered to vacate the residence and surrender firearms. Further investigation revealed Messina possessed an Assault Rifle, as defined by NYS Safe Act, as well as 17 “High Capacity” loaded magazines. In addition he was in possession of several edged weapons, ballistic vests and helmet and a large amount of ammunition.


Messina was charged with one count of CRIMINAL POSSESSION OF A WEAPON/ASSAULT RIFLE 3rd and 17 counts of CRIMINAL POSSESSION OF A WEAPON/FEEDING DEVICE 3rd, both Class D Felonies. Messina was arraigned in the Village of Wappingers Falls Justice Court in front of the Hon. Richard Fiorile. Messina was released to the Dutchess County Department of Probation for a future date in Town of Fishkill Court.


The Town of Fishkill Detective Division assisted Patrol with the investigation and subsequent arrest.
